Density Bonus Law in Santa Barbara: What Multifamily Owners Need to Know in 2026
How California's Density Bonus Law is reshaping multifamily lot values on the Central Coast — and where the loopholes are getting closed.
Quick answer: California's Density Bonus Law (Gov. Code § 65915) lets developers build up to 50% more units — nearly double on deep-affordability projects — than local zoning permits, in exchange for affordable housing. Santa Barbara's City and County each layer their own programs on top, and a 2026 law (SB 92) just closed a loophole letting mixed-use projects oversize their commercial space. For owners of multifamily-zoned lots, this directly affects what a builder will pay.
If you own — or are shopping for — a lot in Santa Barbara, Montecito, Goleta, or the Santa Ynez Valley zoned for two or more units, its real value may have changed in the last two years without anyone telling you. Density bonus law lets developers build more units, taller buildings, and smaller setbacks than local zoning otherwise allows, in exchange for affordable units — one of the most powerful, least understood forces in Central Coast real estate today.
The Basics: What State Density Bonus Law Actually Allows
Enacted in 1979 and substantially strengthened in 2020 and 2023, the law lets a developer exceed a property's maximum zoned density by setting aside a percentage of units as deed-restricted affordable housing. A base bonus of up to 50% is available once affordability thresholds are met (roughly 15% very-low-income, 24% low-income, or 44% moderate-income units), and a second, stackable 50% bonus applies for deeper affordability — meaning some projects can nearly double the units zoning would otherwise permit. Qualifying projects can also request up to four concessions or incentives (reduced setbacks, parking, open space, or FAR), plus waivers for standards that would physically block building at the bonus density. A recent statewide analysis found the reformed law has approved well over 100,000 homes since 2020.
How Santa Barbara Layers Local Rules on Top
The City and County each run their own density bonus programs alongside state law. In the City, a request that doesn't exceed the state-mandated bonus (SBMC Chapter 30.145, or 28.87.400 in the Coastal Zone) can be approved administratively — no hearing required — which matters for R-3/R-4 lots on the Mesa and near the Highlands corridor. The County has also been modernizing its multifamily standards, approving a second phase of zoning reforms in early 2026 that adjust height, setback, and open space requirements, with a third phase expected later this year.
Example: A Goleta-area student housing project on a 0.65-acre lot zoned for 11 units requested a 45% density bonus — five extra units — by setting aside two very-low-income units.
Where "Loopholes" Have Shown Up — and Where Sacramento Has Closed Them
Because density bonus is calculated as a percentage over a project's maximum allowable zoned density — not the units actually proposed — a modest project can unlock a bonus against a much larger theoretical ceiling. The most notable recent fix targets mixed-use projects: developers had used density bonus concessions to expand commercial square footage with no real cap, exposed by a San Diego project where commercial space exceeded zoning by over 1,500%. Senate Bill 92, effective January 1, 2026, caps that increase at 2.5 times the allowed FAR and blocks hotel components from riding on housing incentives.
What This Means If You Own or Are Considering a Multifamily-Zoned Lot in Santa Barbara
Lots in R-3, R-4, or county multifamily zones — or near a major transit stop — can see meaningfully higher offers once a builder pencils out the density bonus potential, and your parcel may be worth more than its current use suggests. But due diligence beats assumption: baseline zoned density, Coastal Zone overlays, and inclusionary housing requirements (which can't be combined with bonus units) all affect the real math on a specific address.

Frequently Asked Question
Does density bonus law apply to my single-family lot?
Only if the property is already zoned for multiple units. Density bonus builds on top of existing zoned density — it doesn't rezone single-family parcels.
